Fountain Hills Town Council approves 5G, wireless telecommunications ordinances

Ends five-year effort

The Fountain Hills Town Council approved ordinances regulating to small wireless facilities and antennas during its Oct. 6 meeting, closing its five-year process. 

The council adopted the ordinance by 5-2 vote with amendments stating that the council act as the board of adjustment; provided definitions of qualifications for outside legal counsel during the appeal process; provided a set decimal level for noise emissions; and set a consistent 500-foot zoning requirement from residential uses and childcare. 

Councilmembers Peggy McMahon and Brenda Kalivianakis were the dissenting votes. Both expressed concerns about the ordinances, with Kalivianakis referencing grammatical errors, wrong legal citations and blank dates. Still, Developmental Services Director John Wesley said the errors listed were minor and he felt comfortable with the draft presented.
