Proposition 138 would change how tipped workers are paid

One proposition on the November ballot could have a major impact on how tipped employees are compensated.

If passed, Proposition 138 would allow employers to pay workers up to 25%, or $3.58, less than the minimum hourly wage of $14.35 if the employer can establish that the employee’s wage, plus tips or gratuities, is at least $2 more than the minimum wage for every hour worked.
