Fountain Hills Planning and Zoning discusses temporary use permits

Recommending Town Council approve changes

The Fountain Hills Planning and Zoning Commission voted unanimously (6-0) to recommend the town council approve changes to rules related to applying for a temporary use permit (TUP) with the town.

Community Development Director John Wesley said the overall purpose statement related to the TUPs is unchanged. However, he has added a section with a statement requiring the permits. Wesley said the new language clarifies the need for the TUP for uses and events not currently specified by the Zoning Ordinance. The language also distinguishes temporary use from activities requiring a special event permit in Town Code.

The following statement is added: “A temporary use permit shall be required for any temporary use that is established on private property, which is short-term or temporary in nature. Examples include uses specifically listed in this ordinance and other uses such as outdoor displays and sales, farmer’s markets and events that utilize parking lots or otherwise use property in a way not part of the approved use. The requirement for a temporary use permit does not apply to any events that receive a special event permit as provided for in …. Town Code or to mobile food vendors operating in compliance with … Town Code.”
