Legislators ask Attorney General’s office to investigate Fountain Hills Town Council

Question whether vote to not fill vacancy violates state law

Arizona State Representatives Alexander Kolodin and Joseph Chaplik, D-3, have sent a letter to the Arizona Attorney General’s Office asking for an investigation of Fountain Hills Town Council action at its Sept. 17 regular council session.

The council deadlocked 3-3 on a vote to appoint someone to fill a vacancy on the council that was announced at the council’s Sept. 4 meeting. There was a motion made to appoint Councilwoman-elect Gayle Earle as she was the only person elected outright at the July Primary Election. The motion failed on the tie vote.

The legislative letter was sent to Hayleigh Crawford, Solicitor General’s Office, Special Litigation Section. The letter states that since the failure of the previous motion, the council has not taken further steps to agendize an item to fill the vacancy.
