Judge issues ruling in Fountain Hills referendum lawsuit

Defendants to receive $4,178 in court costs

Maricopa County Superior Court Judge Frank Moskowitz has awarded a total of $4,178.19 in court costs to the defendants in the referendum lawsuit brought against town officials and developers by the Reclaim Our Town (ROT) political action committee.

Moskowitz had previously ruled that the town had acted appropriately to invalidate petition signatures circulated in the effort to refer a pair of Town Council zoning decisions related to a redevelopment project to include an apartment complex on Shea Boulevard adjacent to the Target shopping center.

The defendants included The Town of Fountain Hills, all seven Town Council members and Town Clerk Linda Mendenhall. The town was awarded $1,589.89.
