Judge hears testimony in Fountain Hills referendum case

Ruling likely sometime early June

Maricopa County Superior Court Judge Frank Moskowitz listened to testimony from those involved in the lawsuit related to the Fountain Hills referendum petitions in his Phoenix courtroom Tuesday morning, May 21. The case involves petitions circulated for two referendums, all of which were turned in with incorrect serial numbers on the back.

After hearing testimony from five witnesses, Moskowitz gave attorneys for the two sides until Friday, May 31, to submit their closing arguments in writing to the court. He said he would render his decision as soon as possible after that date. He was reminded that the case has ramifications for the November ballot if the referendum petitions are determined to be valid. There is also the potential of an appeal to consider.

Moskowitz noted that there are no legal or ordered deadlines related to this case, however, he said he would take the election deadlines under consideration, but added he can only control what he does with the case.
