Fountain Hills candidates receive warning over campaign logos

Cease and desist letter from town attorney

On March 10, potential Fountain Hills mayoral and council candidates received a cease and desist letter from Town Attorney Jennifer Wright on behalf of the town, warning against the use of the town-owned seal and logo in campaign artwork.

In the letter, it states “it has come to the Town of Fountain Hill’s (“Town”) attention that candidates may be using designs that are substantially similar to the Town’s Logo and Seal (collectively referred to herein as “Town’s Marks”) in campaign materials … When the Town’s Marks, or substantially similar designs, appear on campaign materials, it may create the false impression that the Town formally endorses or supports a particular candidate or political issue.

The letter continued, “…This letter serves as a formal cease and desist to all candidates. If you are using an image on campaign materials that is substantially similar to either of the Town’s Marks, continued use on campaign materials may result in legal action.”
