An apology, a clarification and an endorsement in Fountain Hills

OPINION — The U.S. Navy taught me, among other things, to honor your word, respect the law and own your mistakes. This letter does all three.

The Times recently published my opinion criticizing the town’s cease and desist letter directed at one of the mayoral candidates over her campaign logo. I stand by that legal argument. Not being a lawyer, it seems to me that federal law is clear that the town has no legal right to prohibit any candidate from using the fountain image in campaign materials. The fountain belongs to this community.

However, I must be unequivocally clear: I wrote that letter solely as a private citizen, I was not speaking as president of the Fountain Hills Republican Club, nor in any representative capacity on behalf of the club or its membership. That distinction matters and I was remiss in not stating it plainly in the original letter.
