In response to Rep. Kolodin’s recent accolades in a letter

Posted

In a recent letter, Nancy Plencner stated State Rep. Kolodin is a “brilliant constitutional attorney.” Instead of blindly swallowing unsubstantiated superlatives, consider the following facts.

Dec. 2023: Kolodin accepted discipline by the State Bar of Arizona for his role as an attorney in four failed lawsuits related to the 2020 election results. One of the lawsuits was filed by the Republican Party’s 11 fake electors and county GOP officials.

The Federal judge on the case stated that lawsuit was based on "anonymous witnesses, hearsay and irrelevant analysis." According to the Bar, Kolodin violated prohibitions on "conduct that is prejudicial to the administration of justice … and bringing a proceeding … unless there is a good faith basis in law and fact for doing so that is not frivolous." Kolodin accepted an admonition and probation for 18 months, pending his completion of five legal education courses on ethics.

“Constitutional?” Hardly.

Sept. 2024: Kolodin and State Rep. Chaplik requested an investigation by the Arizona Attorney General’s (AG) office regarding the Town Council’s 3-3 vote on a motion to seat Councilwoman-elect Gayle Earle. The Representatives referenced Arizona Revised Statutes 41-194.01 (A). The statute involves “official action adopted or taken by the governing body of a county, city or town.”

In a letter to the Representatives, the AG’s Deputy Solicitor General stated “each of the contemplated subjects of investigation references affirmative official action, while your request appears to concern inaction … We previously invited you to address the validity of the request under the statute but did not receive a response … In the absence of further information indicating that the matter involves affirmative official acts, we must decline the request as outside the scope of (the statute).”

“Brilliant?” When Kolodin and Chaplik can’t even read, let alone understand, the statute correctly? And they’re “legislators?”  Hardly.
