Board of Adjustment decisions

The Board of Adjustment April 16 split its decisions on four variance requests from the operator of the medical marijuana dispensary in Fountain Hills.

The board denied requests for a change in the permitted operating hours for the dispensary and also denied a request for an ATM machine on the premises.

The board determined there was no need for a variance to allow the dispensary to offer water and coffee to its clients on the premises.

It was also determined that a request to allow an outdoor seating area adja-cent to the dispensary did meet the criteria for a variance.

The outdoor area has been on the premises for years and is used by other tenants in the building complex.

All of the board votes were unanimous at 5-0.

Dispensary operator Mark Steinmetz said he may appeal the decision on the operating hours, which would need to be done through Maricopa County Superior Court.

He also said he expects to be ready to open the dispensary around the first of June.
